1. Seller Status & Taxes
DNDiscounter operates as a private portfolio holder, not a registered commercial entity. As such, no VAT (Value Added Tax) or GST is charged on the sale of our digital assets, and we do not issue commercial tax invoices. The transaction summary provided by Escrow.com upon completion serves as your official proof of purchase.
2. Transfer & Inspection Period
All domain name transactions are processed securely via Escrow.com. Due to the digital nature of domain names, the inspection period is strictly limited to 24 hours from the time the domain is successfully transferred to the buyer's registrar account. This strict timeframe protects the asset's integrity by preventing the domain from being used for spam, fraud, or other abuse prior to an attempted transaction reversal.
3. Escrow Fees
The buyer is responsible for paying 100% of the standard Escrow.com transaction fees unless otherwise negotiated and agreed upon in writing prior to initiating the transaction.
4. Buyer's Responsibility & Due Diligence
While DNDiscounter makes every reasonable effort to ensure the domains in our portfolio are clean and in good standing, it is solely the buyer’s responsibility to conduct thorough due diligence prior to purchase. This includes, but is not limited to, checking for active trademarks, verifying domain history, and ensuring no potential conflicts with third-party Terms of Service.
5. Limitation of Liability
By purchasing a domain name from DNDiscounter, the buyer agrees to the following terms:
- Assumption of Responsibility: Once the Escrow transfer is complete, the buyer assumes full ownership and absolute legal responsibility for the domain name and any content subsequently hosted on it.
- No Liability: DNDiscounter, its owners, and its legal representatives shall not be held liable for any legal disputes, trademark infringements, loss of revenue, or breaches of third-party Terms of Service that occur after the transfer.
- External Factors: We are not liable if future changes in technology, internet governance (e.g., ICANN policies), or international law affect the domain's usability, value, or legal standing.
- Agreement: By initiating a transaction via Escrow.com, the buyer confirms they have read, understood, and agreed to these terms in full.
6. Payments & Service Activation (Digital Services)
All digital services—including Strategic Roadmaps, Guidance sessions, Production fees, and Care Plans—officially commence only upon the actual receipt of cleared funds in DNDiscounter’s accounts. DNDiscounter is not responsible for project delays caused by bank processing times, international wire transit, or third-party payment provider holds.
7. Digital Launch Guidance & Roadmaps
The "Strategic Launch Roadmap" fee is a one-time, strictly non-refundable payment. This fee compensates DNDiscounter for the analysis and expert labor required to draft your specific launch strategy. Service is considered fully rendered upon the delivery of the roadmap document or completion of the guidance period.
8. Premium Launch Partnership (Ongoing Support)
For clients who engage our Premium Guidance tier or select the Ongoing Support add-on, this service is subject to the following:
- Duration & Billing: This is a month-to-month service billed at the agreed recurring rate. Support remains active as long as the monthly subscription is in good standing, with no long-term locked contracts.
- Scope: Support covers brainstorming and strategic guidance. It does not include free production labor outside of the agreed-upon project scope.
- Reasonable Demands: DNDiscounter reserves the right to terminate assistance if a project timeline is extended indefinitely due to unreasonable demands or client inaction.
9. Traffic Spikes & Bandwidth Limits
While DNDiscounter endeavors to utilize robust, free-tier hosting infrastructure where applicable, we are not responsible for the costs associated with extreme traffic surges. If a client's website traffic exceeds the free tier limits of our hosting partners or incurs overage charges on connected third-party APIs (e.g., Stripe, Shopify, analytics tools), the client assumes 100% financial responsibility for those specific third-party billing overages.
10. Monthly Care Plans & Maintenance
If a client opts into a Strict Monthly Care Plan, services are strictly limited to the technical upkeep defined at checkout (e.g., specific hours allocated for text/image updates). Care plans do not cover the creation of new pages, complex structural redesigns, or custom database coding. Unused hours do not roll over to the following month.
11. Content Liability & Hold Harmless
The client retains ultimate legal responsibility for all content, products, and services offered on their platform. By utilizing our services, the client agrees to hold harmless and indemnify DNDiscounter and its owners against any legal claims, lawsuits, or regulatory fines arising from:
- Copyright or trademark infringement regarding images, text, or multimedia supplied by the client or requested to be published by the client.
- Violations of user data privacy laws (such as GDPR, CCPA) resulting from the client's business practices or missing/inaccurate privacy policies.
- Any disputes between the client and their end-consumers.
DNDiscounter is a technical vendor acting on the client's instruction; we are not the client's legal counsel or compliance department.
12. Intellectual Property (IP) Rights
Full copyright and intellectual property rights for all final deliverables (logos, website layout, graphics) are transferred to the client exclusively when the client is happy with the end result. All working files (including concept previews and preview media files) and staging environments remain the property of DNDiscounter until the project is finalized and handed over.
